1. Definitions and acceptance
These Terms of Service ("Terms") are a binding agreement between you and Avently ("we", "us", "our"). The "Service" means the Avently website, platform and related services that connect customers with performers for events. By accessing or using the Service you agree to these Terms. If you do not agree, you must not use the Service.
2. Description of the Service
Avently operates an online platform that facilitates introductions and bookings between customers and performers. We are not the employer or agent of performers. The contract for the performance is between you and the performer. We process payments and may facilitate communications in accordance with our policies.
3. Eligibility and accounts
You must be at least 18 years old and have legal capacity to enter into a binding contract. You are responsible for your account credentials and for all activity under your account. You must provide accurate, current and complete information.
4. Bookings and refunds
When you make a booking you enter into a contract with the performer. Payment and refund terms are in our Refund Policy, which is incorporated into these Terms. By completing a booking you agree to the Refund Policy.
5. Prohibited conduct
You must not use the Service unlawfully or in any way that could damage or impair the Service or any user. You must not misrepresent your identity, harass or harm others, or harvest data about users without consent. We may suspend or terminate your access for breach.
6. Intellectual property and liability
The Service and its content are owned by Avently or its licensors. You may not copy, modify or distribute our content without consent. The Service is provided "as is". We are not liable for the acts or quality of performers or other users. Our total liability to you shall not exceed the amount you paid to us in the twelve months before the claim. We are not liable for indirect or consequential damages.
7. Indemnity
You agree to indemnify and hold harmless Avently and its officers and agents from any claims, losses or expenses arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party rights.
8. Changes and general
We may modify these Terms at any time; the updated version will be posted here with a new "Last updated" date. Continued use constitutes acceptance. These Terms constitute the entire agreement between you and Avently. If any provision is invalid, the rest remains in effect. These Terms are governed by the laws of England and Wales; the courts of England and Wales have exclusive jurisdiction. Contact us via Support.
